1. Agreement to Terms

By accessing or using the services of Lard's Towing & Recovery Solutions, Inc. ("we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.

2. Services Offered

Lard's Towing & Recovery Solutions, Inc. provides heavy duty towing, recovery, wrecker services, and related automotive assistance. Our services include, but are not limited to:

• Heavy duty recovery and towing services
• Rotator services
• Landoll services
• Accident recovery
• RV undecking services
• Semi-tractor service
• Air cushion recovery
• Load transfers
• Dock service
• Mobile service

3. Service Availability

We operate 24 hours a day, 7 days a week. However, service availability may be subject to weather conditions, traffic, equipment availability, and other factors beyond our control. We strive to respond to service requests as quickly as possible but do not guarantee specific response times.

4. Pricing and Payment

Service pricing is based on various factors including distance, vehicle type, complexity of recovery, time of service, and equipment required. Pricing will be provided before services are rendered when possible. Payment is due upon completion of services unless other arrangements have been made in advance. We accept cash, major credit cards, debit cards, and various fleet payment methods.

5. Customer Responsibilities

You are responsible for:

• Providing accurate information about your location and vehicle
• Ensuring the vehicle is legally towable (proper ownership, registration, etc.)
• Removing personal belongings from the vehicle before service
• Obtaining necessary permissions if the vehicle is not yours
• Making payment as agreed upon

6. Limitation of Liability

While we take every precaution to protect your vehicle during service, Lard's Towing & Recovery Solutions, Inc. is not liable for:

• Pre-existing damage to your vehicle
• Damage caused by accidents, weather, or other external factors
• Loss of personal property left in the vehicle
• Consequential or indirect damages

Our liability is limited to the value of the service provided or the actual cost of repair for damage directly caused by our negligence, whichever is less.

7. Insurance and Damage Claims

We maintain appropriate insurance coverage for our operations. If you believe damage occurred during our service, you must report it immediately and before your vehicle leaves our custody. Claims must be submitted in writing within 48 hours of service completion. We will investigate all claims promptly and fairly.

8. Abandoned Vehicles

If a vehicle is left in our care and not claimed or payment arrangements are not made within a reasonable period (as determined by applicable state laws), we reserve the right to take appropriate legal action, including storage fees and potential lien proceedings.

9. Indemnification

You agree to indemnify and hold harmless Lard's Towing & Recovery Solutions, Inc., its employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services or violation of these Terms and Conditions.

10. Force Majeure

We are not liable for any failure to perform our services due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or equipment failure.

11. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any modifications constitutes acceptance of the updated terms.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Indiana. Any disputes arising from these terms or our services shall be resolved in the courts of Elkhart County, Indiana.

14. Severability
